After practicing family law for over 15 years, there are topics that are regularly addressed in a first consultation, such as finances, child custody, support issues, property matters, domestic violence matters, and division of assets, but the number one question I receive is, “Should I stay for the sake of the children?”
My answer is: Your children, no matter what age, can sense your unhappiness as well as the household stress. They are not immune to an unhappy relationship and depending on their ages, can and do become embroiled in the marital discourse.
While clearly it may be initially hard on children of divorce and separation, children are resilient and in the long run they want their parents to be happy. When you are happy your children enjoy the time you spend together. When you are not, they are extremely attuned to you and suffer similarly.
The children in these cases become the victims of the marital discourse. The best help you can get for yourself and your children is to consult with an experienced family law attorney and seek professional psychological guidance on how to explain to your children the decision you and or your spouse make regarding the marriage. We can assist you in building an appropriate support team for you and your family.
What you need to remember most about considering your children is that this is a grown up decision. As a parent you are responsible for your own choices. Any decision you make, even if that decision is to put your children’s needs first, you still need to have the decision be about you; your needs, your values, your wants, because this is also your life.
California is a no fault State. In California, you do not need a reason to divorce your spouse. Whether your decision to divorce is based on issues relating to finances, emotions, domestic violence, or other conflict between yourself and your spouse, the Court will grant you a dissolution based on the irreconcilable differences of the parties.
So now it is your decision. No one can help make it for you. With our years of experience in family law matter, we are here to guide and support you through what will knowingly be a difficult time.
